Rules
and Regulations

As announced, the
August 29th Board Meeting dealt with the issue of Rules & Regulations.
The By-Laws and Declarations were reviewed. A discussion was held among
the Board Members, Committee Members and attending Unit Owners. Following
is a list of the Rules & Regulations determined to be most often violated,
or at issue, along with the intended fines which will be attached to future
violations:

ANIMALS:
Not more than two (2) animals having
an aggregate weight of not more than twenty-five (25) pounds shall be
kept within any unit or on the property (except for small birds, which
must be kept in cages, and fish, neither of which may be kept or bred
for commercial purposes).
FINE: $50.00 plus $2.50 per diem from notice.
Owners are responsible for removing and
properly disposing of their animal's droppings within or upon the common
areas. Failure to do so will result in a fine.
FINE: $25.00 for first offense.

PARKING:
Each unit is assigned one (1) private parking space. The visitor
parking spaces are available on a first come first serve basis but no
unit (including visitors to the unit) may occupy more than one visitor parking space at a time and then
for no more than seventy-two (72) consecutive hours. No parking is allowed
outside of the designated parking areas (this means no parking on grass
or in front of the dumpster). Vehicles must be parked within the designated
lines of the parking space and must not intrude into an adjacent parking
space. No vehicle repairs (other than incidental) may be made within the
parking lots or any other common space.
Boats, campers or trailers of any sort are
not allowed in the parking areas or within the common elements.
FINE: $25.00 for first offense.

TRASH:
All garbage is to be deposited in the dumpster; garbage bags are
not to be stored on the balconies or other common elements. No trash or
litter is to be thrown or dropped on the ground or within the common areas.

STORAGE:
Articles of personal property belonging to any Unit Owner (with
the exception of a limited amount of patio furniture and potted plants)
shall not be stored or kept upon balconies or other common areas. Furniture
and plants shall in no case, or in any way, be placed upon or obstruct
any stairway.
FINE: $25.00 for first offense.

NOISE:
No disturbing noise of any sort shall be made within any unit between
the hours of 11:00 P.M. and 9:00 A.M. Loud radios, televisions, stereos,
musical instruments, jacuzzi tubs and even loud talking can be heard from
unit to unit and care should be taken not to intrude upon your neighbors'
right to peaceful enjoyment of their property.
FINE: $25.00 for first offense.

BARBECUING:
Due to insurance and fire code restrictions, barbecuing on the 2nd
and 3rd floor balconies, as well as within the patio areas, is strictly
prohibited. Violation of this Rule could cause cancellation of the Association's
insurance policy and, consequently, the seriousness of the violation is
reflected in the fine.
FINE: $500.00 for first offense.

EXTERIOR DISPLAYS,
DECORATIONS, EQUIPMENT, ETC.:
No Unit Owner shall display, hang, or otherwise exhibit any clothing,
sheets, blankets, laundry or other articles outside a unit or which may
be visible from the outside of a unit (except for draperies, curtains
or shades of a customary nature and appearance, subject to the rules and
regulations of the Board). The following are not allowed: newspaper, foil
or other such window shading materials; painting, decorating or adorning
the outside of a unit; exterior antennae, equipment, signs (except for
sale/rent signs), fixtures or items of any kind (including window air-conditioning
or ventilating equipment).
FINE: $25.00 for first offense.

MISCELLANEOUS:
Any other restrictions described in the Association's Articles
of Incorporation, Declarations or By-Laws.
The Board does not wish to act as a police
force. It is, however, entrusted with the responsibility of seeing to
it that the Rules and Regulations of the Association are made known and
adhered to by all Unit Owners and their Tenants. After all, when each
of us purchased a unit we obligated ourselves, either by intent or default,
to abide by the Declarations and By-Laws. The value of each of our investments
as well as the quality of our living experience within the condominium
complex depends upon the cooperation of each of us. The Board looks forward
to that cooperation.

MODIFIED
RULES REGARDING EXTERIOR POTTED PLANTS
As a result of a lengthy discussion at the March
13, 2001 Board Meeting among the Unit Owners present, Committee Chairs and
Board Members, the following rules have been enacted regarding exterior
potted plants:
DEFINITIONS:
PORCH
2nd and 3rd floor
carpeted exteriors adjacent to the building.
BALCONY
2nd and 3rd floor
uncarpeted platforms on stairwells.
- No more than four (4) potted plants are allowed on any balcony
and they shall not obstruct easy passage to or from the unit(s) or
stairwell(s).
- Only artificial plants are allowed on porches, with a limit
of two (2) per unit. Carpeted spaces are not appropriate for plants
requiring water.
No
plant shall obstruct easy passage to or from the unit(s) or stairwell(s)
- All flower pots containing living plants shall have a catch tray of
adequate size to contain water.
- All flower pots containing artificial or living plants must have at
least a 1" clearance for air circulation between the base of the
catch tray (or pot in the case of artificial plants) and the porch or
balcony surface. This will prevent moisture from accumulating under
the base of the pot.
- Flower pots not containing artificial or viable living plants are
not allowed on porches or balconies.
- No flower pots are allowed on the stairs.
- There are no restrictions on potted plants in the ground floor
patios provided they cause no obstructions.
- There are no restrictions on potted plants at the entrances to the
ground floor units except that all plant displays must be tasteful and
unobstructive. Empty plant pots and plant pots containing dead plants
are not allowed.
- No permanent plantings shall be made in any common space (including
patios) without prior Board approval.
- Any plants hung from railings must have attached drip pans and must
be secured in a manner that they will not be blown off by wind or by
something bumping into them. They shall not in any way obstruct
passage.
WHY
THE RESTRICTIONS?
Our wooden balconies are constructed of pressure treated lumber that
is nearing the end of its useful life. The Association is in the process
of converting these wooden balconies to iron but the conversion is
expensive and will take time. In the interim, we have to preserve the
structural integrity of the wood. Unprotected plant pots without
air-spaces allow moisture to collect, causing more rapid deterioration
of the wood. Once the wood is converted to iron, we still have to
prevent moisture accumulation from rusting the iron plates. The need to
limit the number of plants allowed in these small spaces should be
obvious. Fire codes and insurance requirements dictate that ample space
be provided for movement on the stairwells and balconies.

FINES
Enforcement of the rule changes listed herein will
not begin until April 15, 2001. The fine for the first offense is
$25.00.
